Terms and Conditions

Effective Date: January 16, 2024

By purchasing, accessing and using the services provided by Cold Sweat Therapy, a DBA of Tampa Bay Cold Plunge, LLC, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Acknowledgment of Risks

By participating in cold plunge, hot sauna, and red light therapy services (hereinafter referred to as "Wellness Services"), you acknowledge that these activities involve inherent risks and hazards. These risks include, but are not limited to, shock, fainting, broken bones, strains, sprains, bruises, drowning, cardiac complications, heat stroke, burns, skin reactions, and potential exposure to communicable diseases, including COVID-19.

 

2. Health Screening Clause

You affirm that you have disclosed any pre-existing health conditions that may affect your ability to safely participate in the Wellness Services and that you are not aware of any medical condition that would contradict your participation.

 

3. Release and Waiver of Liability

You hereby release, waive, discharge, and covenant not to sue Cold Sweat Therapy, its officers, employees, agents, or representatives (hereinafter referred to as "Releasees") from any liability to you, your personal representatives, assigns, heirs, and next of kin for any loss, damage, or claim on account of injury to your person or property or resulting in death, whether caused by any negligent act or omission of the Releasees or otherwise while you are engaging in Wellness Services.

 

4. Consent to Emergency Treatment

You consent to medical treatment in case of an emergency or injury while participating in the Wellness Services.

 

5. COVID-19 Clause

You acknowledge the ongoing global pandemic of COVID-19 and the inherent risk of exposure to communicable diseases such as COVID-19 in any public place where people are present. By participating in Wellness Services, you hereby assume all risks related to exposure to COVID-19.

 

6. Cancellation and No-Show Policy

For private bookings, no refunds will be provided for no-shows. Cancellations must be made at least 24 hours in advance to receive a full refund.

 

7. Membership Terms

  • Monthly Membership: Unlimited use for $100 + tax, with recurring payments. Membership can be canceled anytime before the next billing period.

  • Annual Membership: $1100 + tax, with $100 savings. After the annual term, the membership will automatically renew unless canceled.

  • 5 Session Pack: $75 for five sessions, valid for six months.

  • Single Session: $20 per session.

 

8. Use of Facilities

Each session grants full use of our facilities, including cold plunge, hot sauna, and red light therapy services. You agree to follow all facility rules and guidelines.

 

9. Changes to Terms and Conditions

We may update these Terms and Conditions from time to time. We will notify you of any changes by posting the new Terms and Conditions on our website. Your continued use of our services after any changes constitutes your acceptance of the new Terms and Conditions.
